A federal appeals court ruled President Donald Trump’s executive order to end birthright citizenship “unconstitutional”, citing the 14th Amendment.
The 2-1 decision from the 9th US Circuit Court of Appeals keeps a nationwide freeze on the policy, stating it contradicts the Constitution’s guarantee of citizenship to all born in the US.
The ruling may send the case to the Supreme Court, which recently limited the lower court’s reach to curb federal policies. It, however, allowed class-action lawsuits challenging the President’s orders to continue.
Democratic attorneys general from Washington, Arizona, Illinois, and Oregon filed the lawsuit.
A New Hampshire judge also blocked Trump’s order earlier this month.
