Donald Trump’s legal team has until February 12 to appeal to the Supreme Court

A federal appeals court unanimously ruled Tuesday that former President Donald Trump isn’t immune from prosecution for his alleged efforts to overturn the 2020 election results.

The court emphasized that Trump is now a private citizen who doesn’t have executive immunity. 

Trump’s legal team plans to appeal to the Supreme Court. His lawyers assert that a former president cannot face criminal prosecution for official acts without first being impeached by the House and convicted by the Senate.

Yesterday’s decision follows a federal judge’s postponement of Trump’s trial, originally set for March 4. If the ruling stands in the Supreme Court, a trial could follow.
