The Justice Department filed a lawsuit yesterday seeking to block certification of Alaska’s US Senate race if Republican Sen. Dan Sullivan loses. President Donald Trump has said he directed the legal action.

The suit argues that another candidate with the same name could confuse voters and targets Daniel J. Sullivan, a registered Republican also running in the November 3 election. The administration claims his candidacy could divert votes from Senator Sullivan and help Democratic challenger Mary Peltola win.

However, election law experts have questioned the lawsuit’s legal basis and feasibility. They argue that federal law may not authorize the intervention and that officials cannot reliably identify voters who mistakenly selected the other candidate.

Alaska Senator Lisa Murkowski also criticized the lawsuit, saying state officials had already taken steps to distinguish the candidates on the ballot.
