The ban, set to take effect on January 1, will restrict TikTok’s use by blocking it inside Montana’s borders

The same day Montana’s governor signed a bill to ban TikTok, five creators on the platform filed a lawsuit against the state’s attorney general, arguing the ban violates their First Amendment rights.

The ban, set to take effect on January 1, will restrict the app’s use by blocking it inside Montana’s borders. It will further restrict internet service providers and mobile app stores from providing TikTok to their consumers in the state.

The lawsuit filed on Wednesday says, “Montana has no authority to enact laws advancing what it believes should be the United States’ foreign policy.”

Montana Attorney General Austin Knudsen said he is “fully prepared” to defend the bill passed.
