Arizona’s highest court reactivated a 160–year–old abortion ban on nearly all abortions, citing an 1864 law.

The decision, 4-2, replaces the previous rule allowing abortions up to 15 weeks and punishes providers with prison time. The new law gives an exception to save the mother’s life.

It puts Arizona among the 16 states with strict abortion laws, the most restrictive since the Supreme Court overturned Roe v. Wade two years ago. Planned Parenthood Arizona has a 14-day window to challenge the ruling.

President Joe Biden criticized the ban, citing concerns about reproductive rights and access to healthcare.
